1. Introduction

Welcome to HomestayPro. These Terms and Conditions ("Terms") govern your access to and use of the HomestayPro website, mobile applications, and services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services. Our Privacy Policy, found at Privacy Policy, is incorporated by reference into these Terms.

HomestayPro provides an online platform that connects users seeking temporary accommodations ("Guests") with users listing properties for rent ("Hosts") and vehicle rental services ("Vehicle Providers"). HomestayPro is not a property owner, real estate broker, or transportation service provider.

2. Definitions

In these Terms, the following definitions apply:

• "HomestayPro," "we," "our," or "us" refers to HomestayPro Inc., its subsidiaries, affiliates, and assigns.
• "User," "you," or "your" refers to any person who accesses or uses the Services, including Guests, Hosts, and Vehicle Providers.
• "Content" refers to text, graphics, images, music, software, audio, video, information, or other materials.
• "Listing" refers to a homestay or vehicle that is listed by a Host or Vehicle Provider as available for rental via the Services.
• "Booking" refers to a reservation of a Listing by a Guest through the Services.

3. User Account

3.1 Registration

To access certain features of the Services, you must register for an account. You must provide accurate, current, and complete information during the registration process and keep your account information up-to-date at all times.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify HomestayPro immediately of any unauthorized use of your account or any other breach of security.

3.3 Age Restriction

The Services are intended solely for users who are 18 years of age or older. Any use of the Services by anyone under 18 is expressly prohibited. By using the Services, you represent and warrant that you are 18 years of age or older.

4. Booking Services

4.1 Listings

Hosts and Vehicle Providers are responsible for creating accurate Listings and setting the price, availability, and rules for their Listings. HomestayPro reserves the right to remove any Listing from the Services at any time and for any reason.

4.2 Bookings

When a Guest makes a Booking, they are entering into a contract directly with the Host or Vehicle Provider. HomestayPro is not a party to this contract but facilitates the transaction between the parties.

4.3 Accommodation Standards

Hosts are responsible for ensuring that their accommodations comply with all applicable laws, regulations, and standards, including health and safety requirements. HomestayPro does not guarantee the quality, safety, or legality of any Listing.

4.4 Vehicle Standards

Vehicle Providers are responsible for ensuring that their vehicles comply with all applicable laws, regulations, and standards, including safety and maintenance requirements. HomestayPro does not guarantee the quality, safety, or legality of any vehicle.

5. Payments

5.1 Service Fees

HomestayPro charges service fees to both Guests and Hosts/Vehicle Providers for the use of the Services. These fees are displayed before a Booking is confirmed and are non-refundable except as expressly provided in these Terms.

5.2 Payment Processing

HomestayPro uses third-party payment processors to process payments made through the Services. By using the Services, you authorize HomestayPro to use these payment processors to process payments in connection with your use of the Services.

5.3 Taxes

Hosts and Vehicle Providers are responsible for determining and fulfilling their obligations under applicable tax laws. HomestayPro may collect and remit taxes on behalf of Hosts and Vehicle Providers in certain jurisdictions as required by law.

6. Cancellation Policy

6.1 Cancellation by Guests

Cancellation policies vary by Listing and are set by the Host or Vehicle Provider. The applicable cancellation policy is displayed on the Listing page before a Booking is confirmed. Guests are responsible for reviewing and understanding the cancellation policy before making a Booking.

6.2 Cancellation by Hosts/Vehicle Providers

If a Host or Vehicle Provider cancels a confirmed Booking, HomestayPro may impose penalties, including fees and restrictions on future Listings. HomestayPro will assist the Guest in finding alternative accommodations or vehicles, but does not guarantee the availability or comparability of alternatives.

6.3 Force Majeure

HomestayPro may allow cancellations without penalty in cases of force majeure, such as natural disasters, acts of government, or other events beyond the reasonable control of the parties.

7. User Conduct

You agree not to:

• Violate any applicable law, regulation, or third-party rights
• Use the Services for any illegal or unauthorized purpose
• Post or transmit any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity
• Interfere with or disrupt the Services or servers or networks connected to the Services
• Attempt to gain unauthorized access to any part of the Services
• Use the Services to collect or store personal data about other users without their consent
• Use the Services to send unsolicited communications, promotions, or advertisements

8. Limitation of Liability

To the maximum extent permitted by law, HomestayPro and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall HomestayPro's total liability to you for all claims arising out of or relating to the use of the Services exceed the amount paid by you to HomestayPro in the 12 months preceding the event giving rise to the liability.

9. Intellectual Property

9.1 HomestayPro Content

The Services and all Content included on or through the Services, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, are the property of HomestayPro or its licensors and are protected by copyright, trademark, and other intellectual property laws.

9.2 User Content

By submitting, posting, or displaying Content on or through the Services, you grant HomestayPro a worldwide, non-exclusive, royalty-free license to use, copy, modify, display, and distribute such Content for the purpose of providing and promoting the Services.

10. Termination

HomestayPro may terminate or suspend your access to all or part of the Services, without notice, for any conduct that HomestayPro, in its sole discretion, believes violates these Terms or is harmful to other users of the Services, HomestayPro, or third parties, or for any other reason.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in San Francisco County, California.

12. Changes to Terms

HomestayPro reserves the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on the Services and updating the "Last Updated" date at the top of these Terms. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
